A High Court in Kano, located at the Audu Bako Secretariat, has issued an order preventing the Economic and Financial Crimes Commission (EFCC) from taking any actions against Rabiu Musa Kwankwaso, the presidential candidate of the New Nigeria Peoples Party (NNPP) in the 2023 election, as well as seven other individuals.
The applicants in the case are the NNPP, Dr. Ajuji Ahmed, Dipo Olayanku, Ahmed Balewa, Chief Clement Anele, Lady Folshade Aliu, Engineer Buba Galadima, and Senator Rabiu Musa Kwankwaso. The EFCC is the sole respondent.
Justice Yusuf Ubale Muhammad granted the restraining order after reviewing a motion ex parte filed on June 5. The motion was supported by a four-paragraph verifying affidavit, a 27-paragraph affidavit, several exhibits labeled NNPP 1 to NNPP 9, and a written address, all submitted on the same date.
The court’s ruling states: “An interim order of injunction is hereby granted, restraining the respondent, either by itself, its agents, representatives, cronies, or whosoever acting on its behalf, from arresting, detaining, harassing, intimidating, inviting, or in any way infringing on the fundamental rights of the applicants pending the hearing and determination of the motion on notice already filed.”
Additionally, the court directed that the interim order, the motion on notice, and all other related documents be promptly served on the respondent before the next court date.
The hearing for the motion on notice has been scheduled for June 24, 2024.
