Justice John Terhemba Tsoho, the Chief Judge of the Federal High Court of Nigeria, has denied the request from Nnamdi Kanu, the detained leader of the Indigenous People of Biafra (IPOB), to have Justice Binta Nyako recuse herself from his ongoing case. Reports indicate that Justice Tsoho has returned Kanu’s case file to Justice Nyako, emphasizing that two other judges had previously been recused from handling it.

In his decision, Justice Tsoho noted that Kanu’s case has a lengthy history, dating back to 2015, and since Justice Nyako has overseen it for most of this time, she is best suited to bring it to a resolution. However, he specified that if Kanu continues to seek her recusal at the next hearing, he must submit a written motion along with an affidavit detailing the reasons for this request.

Kanu’s special lawyer, Barrister Aloy Ejimakor, confirmed the latest development, stating, “Yes, it is true. We are awaiting a hearing notice to that effect from the Federal High Court.”

Previously, Justice Nyako had recused herself after Kanu and Ejimakor raised concerns about her impartiality, claiming she had ignored orders from the Supreme Court. This latest ruling adds another layer of complexity to Kanu’s ongoing trial.
