Adamawa State has initiated legal action against the federal government at the Supreme Court, disputing alleged unconstitutional deductions from the Federation Account.

The state is requesting a clear interpretation of Section 162 (1), (2), and (3) of the constitution, which outlines the distribution of revenue among all government tiers.

In a statement by Humwashi Wonosikou, the Chief Press Secretary to Governor Ahmadu Fintiri, the state government asserted that all funds in the Federation Account should be distributed without deductions, except those allowed by law. The government emphasizes that the president must adhere strictly to the Constitution in managing and distributing revenue.

Adamawa State maintains that all revenue collected, unless explicitly exempted by the constitution, should be deposited into the Federation Account for equitable distribution among all government tiers.

The state seeks a Supreme Court declaration that any deductions or withholdings lacking constitutional support are unconstitutional. The government underscores that the federal government’s discretion in managing revenue is strictly limited to what the Constitution expressly permits. Adamawa State is pushing for a stringent interpretation of the constitution to ensure revenue distribution is carried out without arbitrary deductions or withholdings by the federal government.
